3.1 Account Creation

To access certain features of the Service, you must create an account using Google OAuth authentication. You agree to provide accurate and complete information during registration.

3.2 Account Security

You are responsible for safeguarding your account credentials and API keys. You agree to notify us immediately of any unauthorized access to your account.

3.3 Account Termination

You may delete your account at any time through the dashboard settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4.1 Service Limits

Your use of the Service is subject to the following limits based on your plan:

Current limits are also shown on our pricing page. We reserve the right to apply additional limits, including a maximum size per bin and a maximum total storage per account, and to change any limit described above with notice on this page.

4.2 Prohibited Uses

You agree not to use the Service for any of the following prohibited activities:

• —Production or critical business data: Any data essential to business operations or that could cause financial loss if unavailable
• —Personal or sensitive information: SSNs, passwords, private keys, health records, financial data, or any personally identifiable information
• —Copyrighted material: Content you don't own or lack permission to use
• —Malicious content: Malware, viruses, or any harmful code
• —Illegal activities: Any content or activity prohibited by applicable laws
• —Service abuse: Spam, automated abuse, or circumventing usage limits
• —Unauthorized access: Reverse engineering, extracting source code, or compromising security
• —Competitive use: Using the Service to compete directly with SuperBins
• —High-availability services: Applications requiring guaranteed uptime or real-time performance

4.3 Rate Limiting

API requests are subject to rate limiting based on your plan. Excessive usage may result in temporary throttling or account suspension.

5.1 Your Content

You retain ownership of all JSON data, configurations, and content you upload to the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, and serve Your Content as necessary to provide the Service.

5.2 SuperBins Intellectual Property

The Service, including its software, design, trademarks, and proprietary features, remains the intellectual property of SuperBins. You may not copy, modify, or create derivative works of our Service.

5.3 Data Retention

Your Content is stored on our servers as long as your account remains active. Upon account deletion, we will delete Your Content within 30 days, though some data may persist in backups for up to 90 days.

6.1 Subscription Plans

We offer both free and paid subscription plans. Paid plans provide additional features and higher usage limits as described on our pricing page.

6.2 Billing

Paid subscriptions are billed monthly or annually in advance. All payments are processed securely through Stripe. Taxes may apply based on your location.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. We do not provide refunds for partial billing periods.

6.4 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, while downgrades take effect at the next billing cycle.

7.1 Service Availability

We strive to maintain Service availability on a "best effort" basis but make no guarantees regarding uptime, performance, or uninterrupted access. Our Service depends on third-party infrastructure (Vercel, database providers) which may experience outages beyond our control.

7.2 Maintenance

We may perform routine maintenance that could temporarily affect Service availability. We will make reasonable efforts to minimize disruptions.

7.3 Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice to users.

8.1 Geographic Limitations

The Service may not be available in all jurisdictions. We reserve the right to restrict access from any location where providing the Service would be prohibited by law or regulation. Users are responsible for compliance with their local laws.

8.2 DMCA Compliance

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on our Service infringes your copyright:

Your data may be processed in countries with different data protection laws than your own. By using the Service, you consent to such transfers. We implement appropriate safeguards, but cannot guarantee compliance with all international privacy laws.

The Service is provided on an "as-is" and "as-available" basis. We make no warranties, expressed or implied, regarding the Service's reliability, availability, or fitness for a particular purpose.

To the maximum extent permitted by law, SuperBins shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, profits, business interruption, or any other commercial damages or losses.

10.3 Maximum Liability Cap

Our total liability to you for all claims arising from your use of the Service shall not exceed the lesser of: (a) $100 USD, or (b) the total amount you paid us in the 12 months preceding the claim. For free users, our maximum liability is $100 USD.

As a sole proprietorship, SuperBins makes no guarantees regarding business continuity. The Service may be discontinued at any time due to business, personal, or financial circumstances of the operator.

12.1 Termination by You

You may terminate your account at any time by deleting it through your account settings or contacting us.

12.2 Termination by Us

We may terminate or suspend your account immediately if you violate these Terms, engage in prohibited activities, or for any other reason at our sole discretion.

12.3 Effect of Termination

Upon termination, your access to the Service will cease, and we may delete your account and data. Sections of these Terms that should survive termination (including payment obligations and limitations of liability) will remain in effect.

We maintain a record of significant updates for our internal purposes. The current version and effective date are displayed at the top of this document. Previous versions may be available upon request.

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where SuperBins is operated, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service must be resolved through individual binding arbitration, not in court. You waive your right to a jury trial and to participate in class action lawsuits.

Either party may seek resolution in small claims court for disputes within that court's jurisdiction, provided the dispute remains in small claims court and is not transferred or appealed to a higher court.

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SuperBins regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
